Motor Cycle Shop Debt

Hi, there is a Motor Cycle Shop in Monaghan. When you pay for parts and other things you never get them and there are lots of people owed. He has sold my bike for me and now I cannot get any money out of him. He is never at his shop and moved. I h

If he left any assets  (such as a house or the ownership of the Shop in Monaghan where he operated from or any stock that is there)  then you could have your Solicitor issue Court proceedings against him and even if he cannot be found your Solicitor can get an Order from Court allowing for “substituted service” of the Court proceedings even though he is not available to receive them. If your loss is less than €2,000.00 you can use the Small Claims’ Court at www.courts.ie. The cost is €9.00

 If he has no assets that can be used to pay you however there is very little that can be done because there is the old saying “you can’t get blood out of a stone.”

Think however about challenging the sale of your bike. If he sold it to a friend at a knock down price then that could be collusion and you may be able to rescind (revoke) the sale and get the bike back.
