Stamp Duty Exemption

I have a query on stamp duty – can you help? My daughter bought a house with her husband last year and was charged stamp duty. She was a first-time-buyer, but her husband was not. The house was bought in both names. I thought first-time-buyers were exempt?

Well Emily, you are right.  First-time-buyers are exempt but your daughter’s husband was not a first-time-buyer and because the house was bought in joint names the Revenue rules say that both must be first-time-buyers before you can avail of any exemption.  That rule gets worse when you consider that if one of the parties owned a property abroad this invalidates the exemption as well.  This rule is very tight and the Revenue Commissioners enforce it very strictly.

 If, Emily, your son in law was previously married and is now divorced there may me a relief available to him but you should check.
