Trouble getting Medical Negligence Evidence

Why does someone have to go abroad for Medical Negligence Cases?

This question relates to the problem of a person mounting a medical negligence action in Ireland against a hospital or a doctor or a clinic having to look for specialist medical evidence from surgeons and specialists aboard.  There are two reasons why this happens.

Firstly that we live in a small country and there are a small number of medical specialists in a particular field all of whom know each other.  It may not seem fair that one medical specialist would not want to give evidence against the other but the reality is that they will, in the interests of their patients meet on a regular basis to discuss cases and to cooperate with new processes that come into place in the medical world.  It is very difficult to do this in a small medical community when you are sitting across the table from a doctor about whom you have written a report saying that their work was incompetent. 

The second reason is and some what allied to the first - because it is a small country and there is a small pool of specialists in the medical area you are unlikely to get a large number of world class practitioners campared to the UK  or the USA.

And this is a very serious problem for many law firms who do take on medical negligence cases.  There are a few specialist law firms who know the qualifications of every surgeon at home and many abroad and can give immediate assessment of what problems might lie ahead.
