Can I get €3,000 house booking deposit back?

Hi. My wife and I put a deposit of €3,000 on a new house. We did not sign contracts because we are finding it difficult to sell our current property. The builder wants to put the property back on the market this Friday unless we sign. What are our rights regarding getting our deposit back? Thanks. Martin

Hi Martin, I am assuming that you paid the deposit and received a receipt marked “subject to contract, subject to loan approval” and the deposit is not stated to be un-refundable.  If this is the case it means that there is no agreement in place until final contracts are signed and that the deposit is merely a booking deposit. 

Legally you are entitled to your deposit back. 

I am assuming that you have already engaged a solicitor for the purpose of buying this new house and for the purpose of selling your old one.  You should take his / her advice.
