Lost an injury case in court

If you lose a strong personal injury case through different errors made by a Solicitor – that is, the info gathering prior to the hearing had gaps which were unveiled in Court, etc. – how does one deal with own Solicitor’s fees in this scenario? Jane.

This is a very subjective question in that Jane firmly believes that she had a very strong case and that she lost it through errors made by her Solicitor. 

If you ask any legal or other professional advisor they find from time to time that they have clients or patients or customers who believe more strongly in their case than the professional advice would suggest but to answer Jane’s question directly – if you lost the case through specific fatal errors made by your Solicitor then you may be entitled to compensation which would include a reduction or indeed non-payment of the bill.  

Jane will have to consult another Solicitor to see what her chances of success are.  This can sometimes be difficult, to find a Solicitor to act against someone else but the Law Society will provide a list of Solicitors willing to take on such cases.  www.lawsociety.ie
