Youth Group HQ legal title problem

The Chairman of a voluntary group bought a house in Carlow for youth group. He cannot contact original solicitor and needs original papers and title deeds of house. What are the options? Eddie. Tallaght.

Hi Eddie, was there a mortgage on the property?  If so, contact the bank to see if they hold the deeds – if not, the solicitor has not complied with the undertaking yet so get the bank to contact the solicitor.

You should go to the Land Registry and check the location of the property on the master plan of the area.    This should reveal the Folio number and you can requisition a copy of the Folio there and then.   This will give details of the registered owner, any rights of way, any special easements and any existing mortgages on the property.

Further investigation by taking up any dealing papers, which will be noted on the Folio, will reveal the names of all the parties involved in previous transactions including the solicitors.

In the unlikely event of the property not be registered in the Land Registry, it would be registered in the Registry of Deeds.

 These two divisions have been recently merged in the Property Registration Authority and for Registry of Deeds properties it is a little more difficult to find out but they will help you in the Public Office. www.landregistry.ie
