Dismissal for poor "Communication"

I was working for two months and was asked to leave the organisation because they said my communication was not what they wanted. I was shouted at by other staff and from the moment I started there they were not disciplined. I was treated differently and feel that my good job record has been taken from me. Anonymous.

Because this listener was not working for twelve months in the job he or she is not automatically entitled to the protection of the Unfair Dismissals Act and the term “bad communication” is a frequent reason given for the dismissal of a worker within that period of 12 months.

 

You may have a separate case for bullying and if that is the position then you should see a solicitor. I would ask however did you have a contract?  And is there a staff manual setting out procedures for handling disputes and discipline.  It should be noted that a contract should be provided and details of anti-bullying policy by law must be included.

 

You mentioned that reason of “bad communication”. Did this have to do with language because of your country of origin or perhaps that you had an inability to speak because of a speech impediment?  If so, that is an entirely different issue and maybe be discrimination with which the Equality Authority may be able to help.  

 

Dismissal of any person who is dismissed because of disability or on the grounds of ethnicity (or any other of the areas covered by the Employment Equality Legislation)  is protected under the Unfair Dismissals Act.You should see an employment law solicitor or contact the Equality Authority at www.equality.ie
