Failed to advise staff of take-over

Our boss sold the company but did not give us 30 days notice or the name of the new owner until the day he took over. Is this legal? Tom.

Hi Tom. 

 

No it is not legal but there are in fact no real consequences. 

 

When transferring ownership of an existing undertaking, employers are obliged to serve notice on all employees giving them 30 days notice of the intended transfer and this includes the name of the new owner.

 

There are in fact no consequences for the employees because they are fully entitled to all the rights under the new regime as they had under the old regime.   The only rights that an employee has where they are not given 30 days notice is to apply to the court for an injunction to stop the transfer.  

 

All that will happen there is that the transfer will be stopped, a 30 day notice will be served and after that the take-over can continue.
