Will be abroad for possible hearing

I am due to go abroad to work soon but haven’t received my summons for a traffic offence, can I send in my solicitor if I can’t make it and defer the hearing. Tom Galway.

Hi Tom.  Yes you can send in your solicitor to have the case adjourned but this doesn’t mean that the court will automatically grant the adjournment.  Remember also that if your solicitor does get the adjournment, the later date might not suit you.

My advice is to go and see your solicitor now, take  his or her advice on the plan to be put in place and accept his or her advice. 

The most important aspect of this is that whoever is living in your house in Ireland should keep a watch out for the arrival of the summons and make sure that your solicitor gets it immediately it arrives.  If this doesn’t happen, your solicitor cannot know that the summons has been issued and the court date will come and a conviction probably entered in your absence with a very high penalty because no one turns up from your side.
