Out of court agreement dishonoured

2 years ago an agreement was agreed out of court between myself and another he was to pay a certain amount plus costs since then he has ignored all contacts from my solicitor what else can I do

Agreement for an out-of-court settlement is exactly that – an agreement or contract – and oddly enough unless the agreement was made “a rule of court” then you have to issue separate court proceedings to enforce the contract. 

This is not as onerous as it may seem because you can sue for a simple debt, the procedure for which is much easier than going to case on a breach of contract dispute.

You should instruct your solicitors to institute debt recovery proceedings immediately based on the agreement and get a judgment as soon as possible.  Incidentally, if the defendant ignores the proceedings the case will not go to court but you can get judgment directly from the court office without having to have a hearing.
