Evidence admissible in High Court

Is testimony in the Medical Council admissible in the High Court?

I am presuming that this listener made a complaint and the Fitness to Practice Committee of the Medical Council investigated and made a particular finding.   Now this listener is taking a case for medical negligence in a Civil Claim to the High Court.

The answer to the question is that any testimony brought before the Medical Council is admissible in the High Court provided it is properly re-introduced and the witnesses turn up in the High Court to give the same evidence. But neither the transcripts of that  evidence originally given nor the findings of the case before the Medical Council will be admissible in the High Court in a medical negligence claim.

The issues raised in the answer to this NewsTalk listener's question are dealt with in a general way as can only be the case on live radio. Before relying on the advice given in this answer, whether you heard the broadcast or are for the first time reading the issues here please do not rely on the broad advice given.
