Partner's visa expiring

Hello Dil. I love the show. I am a gay male in a relationship with a Brazilian man for three years. His visa is up next week. We have been living together for two and a half years but can’t prove this on paper – joint ESB, rent, bank account, etc. What would you and Brian think we have to do, please? Thanks and thanks.

The visa is the defining document and when it expires this listener’s partner has no right to remain in this country.  That said, however, the Civil Partnership Act 2010 is currently waiting for ministerial order to bring it into operation and that will substantially increase this listener’s partner’s right to remain provided the relationship is registered as a civil partnership.

This visa holder should re-apply immediately and if possible get a temporary visa pending renewal.

Dil adds:  "Derek Stewart, Solicitor, in Parliament Street is probably the specialist in this area, as he helped me in my application for citizenship"

Brian concludes:  "Derek has been most helpful to this and other programmes on Newstalk and he or another specialist in emigration law should be consulted"
